30. Matter to be considered in determining compensation.⎯ (1) In determining the 1[**] compensation to be awarded for land acquired under this Ordinance the Deputy Commissioner shall take into consideration, first, the market value of land 2[on the date of order of its acquisition made under section 25]; secondly, the damage sustained by the person interested, by reason of dispossession of any standing crops or trees which may be on the land; thirdly, the damage, if any sustained by the person interested at the time of taking possession of the land by reason of severing such land from his other land; fourthly, the damage, if any, sustained by the person interested at the time of taking possession of the land by reason of the acquisition injuriously affecting his other property, movable or immovable, in any other manner, or his earnings; and; fifthly, if, in consequence of the acquisition of the land the person interested is compelled to change his residence or place of business, the reasonable expenses, if any, incidental to such change. (2) In addition to the value of the land determined as aforesaid, the Deputy Commissioner shall in every case award a sum of fifteen per centum on such value in consideration of the compulsory nature of the acquisition. 2[(3) In relation to land acquired on or after the first day of January, 1996, in addition to the value of the land determined as aforesaid, the Deputy Commissioner shall in every case award a sum of twenty per centum on such value in consideration of the compulsory nature of the acquisition.] 1[(4) Where compensation is provided through land sharing, rehabilitation benefits, resettlement benefits, or any other form as determined by the Authority, it shall ensure that the,⎯ (a) allotted land is of equivalent value, utility and accessibility as the acquired land; (b) rehabilitation and resettlement benefits are provided where required ensuring the restoration of livelihood and standard of living; and (c) compensation package aligns with principles of equity ensuring that affected persons are not placed at a disadvantage due to the acquisition.]
