23. Alternative remedy by suit. Notwithstanding anything contained in sections 15, 16, 17, 18, 19, 20, 21 and 22, the Board may recover by suit any tolls, dues, rates, charges, damages, expenses, costs, or in case of sale the balance there of when the proceeds of sale are insufficient or any penalties or fines payable to or recoverable by the Board under this Act or under any byel aws made thereunder.
