26. Residents not to apply outside Pakistan without permission.—(1) No person resident in Pakistan shall, without written authority granted by the Controller, file or cause to be filed outside Pakistan an application for the grant of a patent for an invention unless— (a) an application for patent for the same invention has been filed in the Patent Office not less than six weeks before the application outside Pakistan; and (b) either no directions have been given under section 25 in relation to the application in Pakistan or all such directions have been revoked. (2) The provisions of subsection (1) shall not apply in Pakistan to an invention in respect of which an application for a patent has first been filed in a country outside Pakistan by a person resident outside Pakistan.
