Section 25: Power of the Commission as civil court

(1) For the purpose of performing its functions under this Act and the rules made there-under, the Commission shall have the same powers as vested in a civil court under the Code of Civil Procedure, 1908 (Act V of 1908), with respect to the following matters, namely:— (a) summoning and enforcing the attendance of any witness and examining him on oath; (b) enforcing the supply of any document or instrument, either in hard copy or electronic format; (c) requisitioning any document or instrument which is available in the public record from any court or office; and (d) accepting evidence on affidavits. (2) Any proceeding before the Commission shall be deemed to be a judicial proceeding within the meaning of sections 193 and 228 of the Pakistan Penal Code (Act XLV of 1860) and the Commission shall be deemed to be a Civil Court for the purposes of section 195 and Chapter XXXV of the Code of Criminal Procedure, 1898 (Act V of 1898).
