Succession to non-occupancy tenancies.– (1) Where a tenant, not being a tenant of land reserved by the land-lord for personal cultivation under any law for the time being in force, not having a right of occupancy and not holding land for any fixed term under a contract or a decree or order of a competent authority dies, the tenancy shall, notwithstanding anything to the contrary in any law for the time being in force, devolve on his preferred heir, if any, and failing such preferred heir on his eldest male child. 26 The Punjab Laws Explanation– A preferred heir means any male child named in writing by the deceased tenant as such. (2) If the deceased tenant has left no such persons as are mentioned in sub-section (1) on whom the right of tenancy may devolve under that sub-section, the right shall be extinguished].
