33. Withdrawal of petition.—(1) An election petition may be withdrawn— (a) before the Tribunal has been appointed, by leave of the Commissioner; and (b) after a Tribunal has been appointed, by leave of the Tribunal. (2) Where leave is granted by the Tribunal, the petitioner shall be ordered to pay the costs incurred by the respondents to the election petition or such portion thereof as the Tribunal may direct.
