28. Penalty for subsequent offence.— (1) Whoever having been convicted of an offence under sub-section (1) of section 27 is 1[convicted for a subsequent] offence under that sub-section shall be punishable with imprisonment for life or with imprisonment which shall not be less than five years and with fine which may extend to two lakh rupees. (2) Whoever having been convicted of an offence under sub-section (2) of section 27 is 1[convicted for a subsequent] offence under that sub-section shall be punishable with imprisonment for a term which shall not be less than two years or more than ten years, or with fine which may extend to two lakh rupees, or with both. (3) Whoever having been convicted of an offence under sub-section (4) of section 27 is 1[convicted for a subsequent] offence under that sub-section shall be punishable with imprisonment for a term which may extend to seven years, or with fine which may extend to one lakh rupees, or with both.
