161. Withdrawal of petition.—(1) The petitioner may, with the leave of the Election Tribunal, withdraw the election petition. (2) Where leave to withdraw is granted under sub-section (1), the Election Tribunal shall order the petitioner to pay the costs or a portion of the costs incurred by the respondents.
