9. The criteria for individual and block exemptions.__ (1) The Commission may grant individual or block exemption in respect of an agreement, which substantially contributes to___ (a) improving production or distribution; (b) promoting technical or economic progress, while allowing consumers a fair share of the resulting benefit; or (c) the benefits of that clearly outweigh the adverse effect of absence or lessening of competition. (2) The onus of claiming an exemption under this Act shall lie on the undertaking seeking exemption.
