11. Court to which petition shall be presented. Every insolvency petition shall be presented to a Court having jurisdiction under this Act in any local area in which the debtor ordinarily resides or carries on business, or personally works for gain, or if he has been arrested or imprisoned, where he i s in custody : 1In its application to the Punjab, a new clause (aa) has been ins. here by the Punjab Relief of Indebtedness Act, 1934 (Punjab 7 of 1934), s. 3. 2 Subs. by the Insolvency (Amdt.) Act, 1927 (11 of 1927), s. 4 for “made under this Act”. 3Subs. by A.O., 1964, Art. 2 and Sch., for “Insolvency (Dacca and the Federal Territory of Karachi) Act”, which had been subs. by the Repealing and Amending Ordinance, 1961 (1 of 1961), s. 3 and 2nd Sch., for “Insolvency (Capital of the Federation and Dacca), Act”. 4The words, “and Dacca” omitted by F.A.O., 1975, Art.2 and Sch., Provided that no objection as to the place of presentment shall be allowed by any Court in the exercise of appellate or revisional jurisdiction unles s such objection was taken in the Court by which the petition was heard at the earliest possible opportunity, and unless there has been a consequent failure of justice.
