Section 33: Powers of the Authority in relation to proceedings

33. Powers of the Authority in relation to proceedings.—(1) The Authority shall, for the purposes of a proceeding in exercise of its powers and discharge of functions under this Act, have the same powers as are vested in a court under the Code of Civil Procedure, 1908, while trying a suit, in respect of the following matters, namely :— (a) summoning and enforcing the attendance of any witnesses and examining him on oath or affirmation ; (b) compelling the discovery or production of any document or other material object; (c) receiving evidence on affidavit; and (d) issuing commissions for the examination of witnesses and documents. (2) Any proceeding before the Federal Government of the Authority or a member of the Authority under this Act shall be deemed to be a judicial proceeding within the meaning of section 193 and section 228 of the Pakistan Penal Code, 1860, and such Government or Authority or a member of the Authority shall be deemed to be a Civil Court for the purposes of section 195 and Chapter XXXV of the Code of Criminal Procedure, 1898.
