5. Appeal.—(1) Any person aggrieved by an order under sub-section (1) of section 4 may, within fifteen days from the date of such order, appeal, in such manner and on payment of such fee as may be prescribed, to the District Magistrate 2[or an Additional District Magistrate], who may, pending the disposal of such appeal, make such orders as he thinks fit. (2) The decision of the District Magistrate 2[or an Additional District Magistrate] on an appeal under sub-section (1) shall be final and shall not be called in question in any court or by any authority [:]3 4[Provided that no decision on an appeal shall be taken unless both the parties thereto have been afforded an opportunity of being heard.]
